1. Purpose and scope

These General Terms and Conditions of Sale («GTC») govern any sale of jewelry made on the website Pur Saphir (the «Site»). Any order placed on the Site implies unreserved acceptance of these GTC by the customer (the «Customer»). These GTC comply with the Quebec Consumer Protection Act (R.S.Q., c. P-40.1) and to Civil Code of Québec.

 

2. Identification of the merchant

The site is operated by Pur Saphir, jewelry store established in Quebec, Canada.

3. Jewelry and gemstones

Pur Saphir offers jewelry adorned with precious and fine stones, notably sapphires. Each piece of jewelry is presented on the Site with a description that is as accurate as possible (metal, weight, dimensions, stone characteristics).

Unique character of natural stones:

Natural stones are unique: slight variations in color, inclusions, or shades may exist between the photographed piece of jewelry and the one delivered. These variations do not constitute a defect, but attest to the authenticity of the stone. The photographs are non-contractual and colors may vary depending on screen display settings.

Certificates:

When a piece of jewelry is accompanied by a certificate of authenticity or a gemological laboratory report, it is included with the delivery. The certificate is an integral part of the jewelry and must be kept.

 

4. Prices and taxes

Prices are indicated in Canadian dollars (CAD). In accordance with Quebec law, the advertised price includes all mandatory fees, with the exception of applicable taxes (GST and QST) and delivery charges, which are indicated before order confirmation. Jewelry prices may be adjusted at any time, notably based on the market price of precious metals and stones, with jewelry being billed at the price in effect at the time of the order.

 

5. Order

The order is confirmed after payment validation. A confirmation email summarizing the order (jewelry, price, taxes, fees, and delivery times) is sent to the Customer, in accordance with the requirements applicable to distance contracts. Pur Saphir reserves the right to refuse or cancel any order in the event of a manifest pricing error, unavailability of the piece of jewelry, or for any reasonable grounds, in which case the Customer will be fully refunded.

Custom and personalized jewelry:

Custom, engraved, or made-to-measure jewelry orders requested by the Customer (for example, ring sizing) are put into production after payment confirmation. Manufacturing lead times are communicated to the Customer prior to ordering.

 

6. Payment

Payment is made securely online via Stripe. Credit card information is neither collected nor stored by Pur Saphir. The order is processed only after payment authorization.

 

7. Delivery

Deliveries are made by GLS and FedEx at the address provided by the Client. Given the value of the jewelry, shipments are insured and sent with tracking; a signature may be required upon receipt. Delivery times are indicated at the time of the order. In accordance with the Consumer Protection Act, if the jewelry is not delivered within 30 days Depending on the scheduled delivery date, the Customer may cancel their order and obtain a full refund. It is the Customer's responsibility to check the condition of the package upon receipt and to report any damage as soon as possible.

 

8. Return and Refund Policy

Return period:

The Customer has a period of 30 days following the receipt of their order to request a return, by writing to info@pursaphir.com.

Return conditions:

  • The jewelry must be new, unworn, unaltered, and free from any signs of wear.
  • The piece of jewelry must be returned in its original box and packaging, accompanied by its certificate of authenticity where applicable.
  • Any potential security label must be intact
  • Proof of purchase (order number or invoice) is required

Jewelry not eligible for return:

  • Custom-made jewelry or jewelry made to the Customer's order
  • Engraved or personalized jewelry
  • Rings sized at the Customer's request
  • Earrings, for hygiene reasons
  • Sale or clearance jewelry identified as final sale

Fees and terms:

Return shipping costs are the responsibility of the Customer, except in the event of an error by Pur Saphir or a defective piece of jewelry. The return must be made via an insured shipment with tracking and signature, up to the value of the jewelry; it remains the responsibility of the Customer until received by Pur Saphir.

Refund:

Each returned piece of jewelry is inspected by us (condition, authenticity of the stones, presence of the certificate) before a refund is issued. The refund is made to the original payment method within a maximum period of 15 days. In the event of cancellation of a distance contract in accordance with the Consumer Protection Act, the refund shall be made within 15 days following the cancellation.

 

9. Cancellation of a distance contract

In accordance with sections 54.1 and following of the Consumer Protection Act, the Customer may cancel their order, notably if:

  • The mandatory information was not disclosed to him before the conclusion of the contract
  • He did not receive written confirmation of his order within 15 days
  • The piece of jewelry was not delivered within 30 days of the agreed date

Where applicable, the Customer may also request a chargeback from their credit card issuer if the refund is not made within the timeframes provided by law.

 

10. Legal guarantees

All jewelry comes with legal warranty of quality provided for by the Consumer Protection Act and the Civil Code of Québec: they must be fit for the purpose for which they are normally intended and have a reasonable durability, given their price and conditions of use. This warranty applies at no additional cost and is in addition to any conventional warranty offered. In the event of a covered manufacturing defect (for example, a defective setting or a non-functional clasp), the Customer may request the repair, replacement, or refund of the jewelry.

 

11. Maintenance and liability

Jewelry is delicate pieces that require proper care. Pur Saphir cannot be held liable for damage resulting from:

  • From an impact, misuse or inadequate maintenance (chemicals, chlorine, perfumes, cosmetics)
  • Normal wear and tear of the jewelry (metal scratches, natural tarnishing, stretching of a chain)
  • From a modification or repair performed by a third party
  • From the loss of a stone following an impact or deformation of the setting by the Customer

Nothing in these Terms and Conditions limits the rights granted to the Customer by the Consumer Protection Act, as these rights are a matter of public policy.

 

12. Personal data

Personal data collected in connection with orders is processed in accordance with our Privacy Policy and to Quebec's Law 25.

 

13. Governing law and disputes

These General Conditions of Sale are governed by the laws applicable in the province of Quebec and the laws of Canada that apply thereto. In the event of a dispute, the Customer may contact’Quebec Consumer Protection Bureau. Failing an amicable settlement, any dispute shall be submitted to the competent courts of Quebec.
